1Agreement to These Terms
These Terms & Conditions (the "Terms") are a binding agreement between you (the "Client," "you") and
Widgy Normil Photography™ (the "Seller," "we," "us"), the provider of the Wedding Experience
Designer commissioning service offered at getyours.widgynormilphotography.com (the "Site").
By submitting the commissioning form, checking the acknowledgment box at checkout, and/or completing payment,
you confirm that you have read, understood, and agree to be bound by these Terms in their entirety — including,
without limitation, the All Payments Are Final policy in Section 4. If you do not agree to these
Terms, do not submit the form or complete a purchase.
2The Services
The Seller builds custom, made-to-order "Wedding Experience Designer" web applications (the "Deliverables")
for photography, videography, and creative studios, offered in two packages:
- Fully Managed — $110 to start ($100 setup + your first month), then $10/month. We build,
host, secure, and maintain your build; includes your branded web address, lead delivery to your inbox, and
reasonable monthly pricing/copy updates on request.
- Self-Hosted — $150 one-time. We build your experience and deliver the code and embed
snippet with installation instructions. You host, install, and maintain it yourself; future changes are
billed separately.
Every build is commissioned custom work, produced specifically for your studio from the
information you provide in the intake form. Work begins promptly after payment is received.
Read Carefully — This Section Governs Every Purchase
3All Payments Are Final — No Refunds, No Returns, No Exceptions
Every payment made through this Site is final, non-refundable, and non-reversible.
By completing checkout you expressly acknowledge and agree that:
- You are purchasing custom-commissioned digital work, produced specifically for you.
Production begins shortly after payment, and the value of that work is delivered through labor and
proprietary code that cannot be un-performed or returned.
- No refunds, returns, exchanges, credits, or cancellations will be issued for any reason
after payment — including change of mind, dissatisfaction with subjective/stylistic preferences, failure to
provide required information, failure to use the Deliverables, or abandonment of the project by you.
- Once the Deliverables are delivered to you — whether as source code, an embed snippet,
access credentials, or a live hosted site — there is no turning back. Digital code, once
received, cannot be "given back," and delivery permanently extinguishes any possibility of refund or
reversal.
- You waive any right to dispute, reverse, or charge back any payment made under these
Terms, except in the case of proven unauthorized use of your payment method. Any chargeback or payment
dispute filed in breach of this Section will be contested with full evidence — including your form
submission, your checkout acknowledgment of these Terms, and delivery records — and you agree to reimburse
the Seller for all amounts recovered against us, plus any chargeback fees and reasonable costs of
responding.
- For the Fully Managed package, this Section applies to the initial $110 payment and to each $10 monthly
payment once billed. Cancelling the subscription stops future billing only (see Section 7) — it
never entitles you to a refund of amounts already paid, in whole or in part.

welcome — refunds are never available.
4Your Responsibilities
- You warrant that all information you submit is accurate and that you are authorized to purchase on behalf
of your studio.
- You warrant that you own, or hold all necessary rights and licenses to, every logo, name, image, price
list, and other material you supply, and that our use of those materials to produce your build will not
infringe any third party's rights. You agree to indemnify the Seller against any claim arising from
materials you supply.
- You agree to respond to reasonable requests for information needed to complete your build. Delivery
timelines depend on your cooperation; delays caused by you do not entitle you to any refund or credit.
- You are responsible for the accuracy of the pricing and offer information displayed in your build. The
Seller bears no liability for bookings, quotes, or expectations created by content you approved or supplied.
5Delivery & Acceptance
Typical delivery is 3–5 business days after we have received both your completed form and
your payment. This is an estimate, not a guarantee; reasonable variations do not constitute breach and do not
entitle you to any refund.
Deliverables are deemed accepted upon delivery. If you believe a Deliverable contains a
genuine error — meaning a material deviation from the information you submitted, not a change of preference —
notify us within 7 days of delivery and we will correct it at no charge. Correction of errors
is your sole and exclusive remedy. Requests beyond error correction (new content, redesigns, additional
features, changed pricing) are new work, quoted and billed separately.
6Intellectual Property & License
The Wedding Experience Designer — including its concept, design, flow, source code, and underlying system —
is and remains the exclusive proprietary property of the Seller. No purchase transfers
ownership of any intellectual property.
- Fully Managed: you receive a limited, non-exclusive, non-transferable license to use
your hosted build for your own studio for as long as your subscription remains active and paid.
- Self-Hosted: you receive a perpetual, non-exclusive, non-transferable license to install
and use the delivered code for one studio brand on websites you own.
Under either license you may not resell, redistribute, sublicense, publish, or share the code or embed
snippet; use it for any brand other than your own; or use the Deliverables, the Site, or the intake form to
copy, reverse-engineer, or develop a competing product. Any such use terminates your license immediately,
without refund, and the Seller reserves all remedies at law and equity.
7Fully Managed Subscription Terms
- The $110 initial payment covers setup and your first month of service. Service then continues at
$10/month.
- You may cancel at any time by emailing
widgynormilphotography@gmail.com. Cancellation takes
effect at the end of the period already paid for. No prorated or partial refunds are given
for any period.
- If a monthly payment fails or is not made, we may suspend and subsequently take down your hosted build
after reasonable notice. Reinstatement may require payment of missed amounts.
- Upon cancellation or termination, your hosted build and branded address are taken offline. Your lead
data remains yours, and we will provide a copy of leads received through your build upon written request
within 30 days of cancellation.
- We may adjust the monthly rate with at least 30 days' notice; continued use after the effective date
constitutes acceptance. You may cancel before the new rate takes effect.
8Disclaimer of Warranties
The Site, the Services, and all Deliverables are provided "as is" and "as available."
To the fullest extent permitted by law, the Seller disclaims all warranties, express or implied, including
merchantability, fitness for a particular purpose, and non-infringement. The Seller does not warrant that the
Deliverables will be uninterrupted or error-free, and makes no promise or guarantee of any business
outcome — including leads, inquiries, bookings, conversions, or revenue. Third-party services
(hosting providers, payment processors, your own website platform, DNS providers) are outside the Seller's
control and are governed by their own terms.
9Limitation of Liability
To the fullest extent permitted by law, the Seller's total aggregate liability arising out of or relating to
the Site, the Services, or the Deliverables shall not exceed the total amount you paid to the Seller
in the three (3) months preceding the event giving rise to the claim. In no event shall the Seller be
liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost
profits, lost business, lost data, or loss of goodwill, even if advised of the possibility of such damages.
10Indemnification
You agree to defend, indemnify, and hold harmless the Seller from and against any claims, damages, losses,
and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of
the Deliverables, materials you supplied, or content displayed in your build at your direction.
11General
- Governing law & venue. These Terms are governed by the laws of the
State of Florida, without regard to conflict-of-law rules. Any dispute arising out of or
relating to these Terms, the Site, or the Services shall be brought exclusively in the state or federal
courts located in the Florida county where the Seller maintains its principal place of business, and you
consent to the personal jurisdiction of, and waive any venue objection to, those courts.
- Attorneys' fees. In any action to enforce or interpret these Terms, the prevailing
party shall be entitled to recover its reasonable attorneys' fees and costs, including on appeal, in
addition to any other relief awarded.
- No cancellation period. You acknowledge that this is a business-to-business purchase of
commissioned digital services and that no statutory "cooling-off" or cancellation period applies. Your
order is final at the moment payment is completed.
- Entire agreement. These Terms, together with the Privacy
Policy and Cookie Policy, are the entire agreement between you and the
Seller regarding the Services and supersede all prior discussions.
- Severability. If any provision is held unenforceable, the remainder continues in full
force, and the unenforceable provision is deemed modified to the minimum extent needed to make it
enforceable.
- No waiver. Failure to enforce any provision is not a waiver of the right to enforce it
later.
- Changes. We may update these Terms from time to time; the version posted at the time of
your purchase governs that purchase.
